FEMPPA Letter to the Secretary of Communications and Transportation Regarding the Civil Aviation Regulations (1998)

Dear Mr. Secretary:

We greatly appreciate the warmth with which you received us this past Monday, the interest you demonstrated in the future of Mexican private non-commercial aviation, and the generosity with which you offered your assistance.

As you directed, we were provided with a copy of the latest version of the proposed Regulations to the Civil Aviation Law, which we analyzed immediately and found to be highly detrimental to the segment of aviation that we represent. The regulatory proposal that we prepared at the request of the DGAC and submitted during the first days of February, of which you now have a copy, was not considered at all.

When the Civil Aviation Law was enacted, we were told that the aeronautical authority was aware that, due to the haste with which it had been drafted, non-commercial aviation had not been given appropriate treatment, but that the deficiency would be corrected in the Regulations. We are now being told the same thing regarding the Regulations and are being assured that the deficiency will instead be corrected through Standards.

For this reason, we respectfully request your intervention so that the draft Regulations provided to us be made applicable exclusively to commercial aviation and expressly state that their provisions may not be applied to private non-commercial aviation.

We also respectfully request that, as was offered to us, the regulations governing private non-commercial aviation be drafted using as their foundation the proposal that we prepared. We are willing to collaborate in every way necessary to achieve this objective.
